What is it you want to know?

To my most recent guest, "Chicken Sh*t" (from the Ottawa, ON area -- you know who you are).....

So, ya decided to Google me, did ya? Heck, what do you want to know? I've never made any attempt to hide my identity (I did note that YOU posted here anonymously though).

I'll help you out a bit;

1) the 7/8 year old you find in the White/Yellow belt Karate tournament in BC -- not me (but my parents live about 20 miles from there, how weird is that?)

2) the address/business you find in Florida -- no longer at that address either (phone numbers are bad too)

3) the 'quote' you find as being credited to me (some guy uses it on eBay) -- not mine, but I have used it as I do like it (are you the one?)

4) thesafeguys.com -- yep, my site -- I am a Certified Master Safecracker

5) internet-locksmith.com -- nope, no longer mine -- and hence your "thief" comments, but we'll get to that in a minute

6) the stuff you find from dragonflycms.com, myndworx.com, xtremethemes.com and other such places -- yeah, I like to dabble in PHP programming every now and then

7) the reference to being a "Clearstar member from outside the USA" -- no longer a member (hey, I've got my own sites!) -- Wow! That was a while ago... still a Certified Journeyman Safecracker!

8) FireKing University and MBA references -- just some of the places I've been trained at

OK, so I just got home from work -- I'm hungry, and my dinner is far more important than replying to some guy (girl, kid -- whoever you happen to be) Googling me, quoting things they find in an attempt to make me look bad. I have simply 'unpublished' your comments for now, but will be more than happy to repost them here (in the proper place mind you, not thoughtlessly placed amidst a thread that has nothing to do with your comments) and will do so later this evening.

Stay tuned! (UPDATED -- read more -- this is VERY LONG, be forwarned!)

OK, so here are the comments from my latest guest "Chicken Sh*t". Actually, there are no comments from this guest, but rather a lengthy quote from another website, in a vain attempt to make me look bad.

You have taken my authored work without authority. It is requested that all my copywritten material be "returned" in complete original form.

You are not authorized to destroy, remove, or delete the original work for the purpose of disposal in lieu of the rightful return of property.

Upon return of these original works of authorship, then and only then are you to eliminate the stolen versions you have in your custody.

At no time was an authorization or agreements between Kyle Stubbins, www.locksmithcommunity.com, www.lockanswers.com or any other agent thereof granted permission to utilize such copywritten works.

Return of these works should be immediate and a complete removal of any names, membership numbers or account data purged from the previous records obtained without my eplicit authority or that of the owner of www.Internet-Locksmith.com

The above email maybe used by others and edited to be used for you to "obtain" your written work. Legally you have a right to have your work RETURNED not deleted. I would recommend that you take this course of action rather then just request deletion. It's your right.

Many relevant and historical works were provided regarding the NASTF Vehicle Security Committee and other important topics. These files were "completely" removed from IL and wiped out once the mirror site was exposed for taking the database of IL, however they have been found on the mirror site without my permission.

This is blatant and vindictive THEFT by all parties involved. IMO

On Sunday March 11th, an email was forwarded to have my copy written material returned from persons who had taken them without authority. This was done similar to others who had asked to have their material removed from this bootleg website. I on the other hand prefer my written material to be returned. As a result of attempting to resolve this issue, the thieves IMO responded as such .....

Kyle Stubbins - Staff Administrator
Kyle Stubbins, CMS
Stubb Safe & Vault, Inc.
Hamilton, Ontario
Location: Canada

[i]We had been offering to remove posts / accounts at the request of former members. Once again, Tom, you've screwed everyone out of that option by playing your little games. Enough is enough.

No further accounts or posts will be removed from LocksmithCommunity.com
--------------------------------------------------------------------------------

Games? This guy and crew steal my rightful material then claim it a game? This is the exact type of reaction Mr. Stubbins portrayed when trying to communicate concerns in the past.

What these thiefs IMO fail to acknowledge is the following....

All logos and trademarks in this site are property of their respective owner. The comments are property of their posters, all the rest © 2000 - 2006 by INTERNET-LOCKSMITH

Mr Stubbins is not and has never been the OWNER of the above mentioned domain, so he and his pals have no rights to my or any others written works without permission.

Return the items you wrongfully have taken Mr. Stubbins

For the record and clarity to avoid the historical manipulation by Mr. Stubbins and his agents when it comes to communications, I have copied a subsequent email in reponse to his tatrum seen above.

To Kyle Stubbins

It appears you are acting out again rather then simply cooperate. I am flattered that you want ownership of my past written work, but I prefer they be returned. So please post this email as well. You fail to recognize one thing and it is this...

All logos and trademarks in this site are property of their respective owner. The comments are property of their posters, all the rest © 2000 - 206 by INTERNET-LOCKSMITH

Mr Stubbins is not and has never been the OWNER of the above mentioned domain (if so please presented documentation for proof), so he and his agents have no rights to my or any others written works without permission. I am the "poster" of such work and as described in the above reference clearly written on the bottom of www.internet-Locksmith.com pages - I own the property.

Return the items you wrongfully have taken IMO Mr. Stubbins, it is as simple as that.

How HISTORICALLY funny, that once again Mr. Stubbins and crew fail to present information openly, honestly and balanced.

A response email was delivered to him as you see in the above posting. Yet no subsequent plastering of the email on the bootleg website as he had done instantly with my first communication. How funny that Mr. Stubbins instantly (during his tantrum) posted my 1st email on his home page in public view YET witholds the second response.

Classic, information control by he and pals. He chooses to attempt to present his version or interpretations while disregarding the right of the posters property.

Anyone associating themselves with this activity is equally guilty.

As expected Kyle Stubbins and the rest of the thieves IMO have failed to present my communications in a complete format after 24 hours.

The manipulation of how they misrepresent a situation is as clear as day. I had to laugh when I saw a the opening post of "Internet Locksmith Cyber Piracy" thread written here, as being presented in their public view forum as if LR had "sent an email message" of that topic to them - they can't even lie accurately. Never happened. Laughing Laughing Laughing

Message from Lock Radio!!! Laughing Laughing

The only message sent was the posted email where they asked to return written works belonging to the rightful authors (which they refuse to do)

What Mr. Stubbins fails to tell everyone is that he wrote this according to Mr. Dan Davies the OWNER of the real Internet-Locksmith.com, however Mr. Stubbins prides himself on trying to use a portion of the terms of use of IL to try to circumvent this crystal clear copyright notice.

A portion...that recognizes the OWNER of the website not his server administrator which Kyle Stubbins was.

PLEASE RETURN THE WRITTEN WORKS OF OTHERS

The comments are property of their posters

It wouldn't have surprised me if Tom would have started his little game here (aren't you getting tired of losing, Tom?), but I'm quite sure that this came from someone who has no idea what this is even about -- it is purely an effort to make me look bad.

Here is my reply, which can also be found HERE and another HERE, and yet another HERE -- Oh yeah, the original post Chicken Sh*t refers to can be found HERE and another HERE;

Hello, and welcome to the 'new' site for Professional Locksmiths and Safe Technicians -- LocksmithCommunity.com!

I had originally intended to have this post done before we opened our doors (which we did last night), but as things would go, the cat got let out of the bag a couple of days sooner than we had planned. Heck, we knew it wouldn't be long! This post was, originally, going to be designed to let you know who we are and what is happening in the LocksmithCommunity -- now it seems that it will be that, along with a rebuttal post in response to comments posted over at IL.

"abyss -- INTERNET-LOCKSMITH"

I hope you will enjoy running your new website knowing that it's roots will forever be remembered as a stolen product of INTERNET LOCKSMITH.

I'm not going to get involved with any legal action but what I will do is to place a black curse on all who are involved in the theft of INTERNET-LOCKSMITH.COM software and database files.

You can copy of the files, You can make the site look the same but you cannot duplicate my dedication and vision that drives INTERNET LOCKSMITH.

Finally, I guess this is what happens when trust is given to a person that I have never knew or met.

First, let's take a look at the WayBackMachine -- INTERNET-LOCKSMITH, the name, was started by Dan Davies -- the site was started by me. What you may not know is that it was originally started as mysafetech dot com (I don't want it to link here as I don't own the domain anymore and don't know who does!) -- have a look.

I won't get into the nitty-gritty of it all -- to make a long story short, Dan saw my site and asked me if I would be interested in becoming partners with him and moving my site to the internet-locksmith.com domain (I can't give you a way back as I purposely blocked robots from IL) -- after numerous discussions with Dan, I agreed and the "new" INTERNET-LOCKSMITH was born.

At the time, we were running the software "phpNUKE". Some of you will remember the infamous "monkey" incident at IL -- yes, we were hacked due to the software we were running and had all of our index pages changed to a picture of a monkey (by a brazillian hacker group). At that time (the php scripting language not being my strong point), I found that phpNUKE was not secure and decided to convert the site to another CMS (Content Management System), called CPG-NUKE. Shortly after that, CPG-NUKE evolved into "DragonflyCMS", which is our current software.

Upon switching over to DragonflyCMS, my php scripting had improved 10 fold since the time we started IL, and I joined the development team at DragonflyCMS. I have been helping design, modify and debug the software since November of 2004. My DragonflyCMS profile (Note: member groups are now hidden on DragonflyCMS.org -- but hey, do a search in the forums for "safecracker4hire"!)

Since then, I have also joined myndworx.com, which is a development site for add on modules / plugins for DragonflyCMS. You can see my Myndworx profile here. As you can see there, WeblinksPro was one of my last projects for DragonflyCMS. You can also see that I was included in the development of ForumsPro (what we run here as a replacement to DF's forums), ProjectsPro, ShopKeeperPro and a host of others. What you won't see at either of these places are the modules I wrote specifically for IL;

The IM System
Find-A-Locksmith
The LIST Glossary Backend
Access-X-Reference
CombinateIt-IC
Scorpion CX-5
Last Seen
The Legal Module
(and I'm probably missing some)

All modules, written by me, for IL. None of which have been released as GPL. This does not even mention the countless hours of modifications that I have done to the software, again, specifically for IL -- the system was never intended to be used the way it was used on IL -- that was my custom work. More on this in a minute.

The topic of "turning IL into a pay site" was discussed many times by Dan, myself and the Staff at IL -- I clearly stated that I would have no part in a pay site -- this was about education, not money. If the decision was made to go pay, I would walk away -- after all, that decision I could not really influence -- Dan owned the DOMAIN NAME, so my only choice would be to take the site to another server and domain name.

During the first half of 2006, I was extremely disappointed at the direction IL was heading -- the site was becoming what it was never intended to be (I won't even talk about starting thesafeguys.com because I wanted to distance myself from IL). In August of 2006, instead of "taking my ball and going home", I choose to simply walk away, leaving Dan with everything I had ever done for the site. The software is yours to use. At this point, the site was NOT a pay site, nor were there intentions as to such -- so I walked away, leaving the site for the benefit of the Locksmithing industry. You see, my visions for a site of this nature were all based on education for the industry.

Many of you may not remember "Ledger World", a convention that used to be run by the industry magazine "Locksmith Ledger". Wow! All conventions should have taken example from this fine organization! All classes were free! FREE! When I first started out as a locksmith, I hit this convention every year and, literally, ran to and from classrooms. I wouldn't be where I am today without it. IL was my chance to give back to the industry (which was the initial goal of mySAFETECH dot com).

However, with the recent announcement on IL that it was going to become a pay site, I was contacted by numerous members who asked if I would, once again, run a locksmith community site. Up until 5 days ago I had NO intentions of ever running another site such as IL -- NONE at all. However, now that IL has officially announced that they will be going to a pay site (and have begun to collect money for membership), the ball has bounced 'out-of-bounds'. I have said since day one on IL -- THE SITE WILL ALWAYS BE FREE -- and I am sticking to that promise. Welcome to the, still free, and new industry standard in Locksmithing websites -- LocksmithCommunity.com.

This brings me to the 'data'. Dan and I both owned the content of the site. Dan owned the domain name, I owned the software -- collectively, we owned the content. Technically speaking, you, the poster, own the posts that you post in the forums. The data is not owned by either Dan or myself. As I have said, I walked away in August of 2006 -- accordingly, the data that I have is from the sites inception to the point I walked away. This data has now become 'derivative works', as laid out in IL's TOU, Section 7A -- the posts, prior to August 2006, are a 'compilation' of posts, which includes the Tech forums as most every other forum has had it's data removed. Private Messages, Downloads, News and anything else that was specific to IL has been removed from this site. The site, IL, was built for the members, by the members. I am not about to see the members who have contributed great technical data, have to pay to access that same data, believing that they would always be able to do so by being under the impression that IL would always be a free site.

As I said, I walked away in August of 2006 - I have data up until that point. Even though IL has only become a pay site in March of 2007, I will not use any data, post August 2006. Anything posted after August 2007 (well, technically, March 2007) is posted under a 'paid' membership and will, therefor, have to be paid for by people who wish to access this new data -- that is Dan's right and I will not deny him that.

As for "duplicat[ing] my [Dans] dedication and vision that drives INTERNET LOCKSMITH." -- I should really put up a ROTFLMAO smiley! Yeah, Dan, you keep thinking you are the 'driving force' behind IL! A lot of my 'walking away' had to do with your lack of presence. Damn, IL went down about 2 months ago and members were calling me asking what was going on -- I didn't know, so I redirected them to you -- to which I was told they had been trying to get a hold of you and could not. In return, I found out why the site was down and never posted the reason -- what I did do was setup temporary forums on thesafeguys.com for the members of IL to use until the situation could be rectified by you -- because I didn't want to see the members suffer. As I've said, the site was built for the members, by the members -- it had nothing to do with you or I.

As for "trust" -- I'm not even going to touch that. I am a stand-up guy -- I say what I mean, and mean what I say. I know who I am and what values and morals I live by -- that's is all that matters to me.

A "Black Curse" -- bring it on! I am a believer in "The Secret". YOUR negative thoughts have no effect on me. MY positive thoughts are 100 times more powerful -- the "Law of Attraction" is very powerful within itself.

And a reply from Dan Davies, my former partner with internet-locksmith;

Kyle does write the way it WAS or the way it is, But he did forget to mention a few things that happened even before we got involved in IL together.

Many moons before we got together I hosted his domain(s) and Kyle could not get his (CGI) forum scripts to work, I helped Kyle with his (CGI Paths and permissions).

And that's how we became friends.

OH did I forget the time when he was (WMMIA) for 3 months or more, I guess he was finding himself and was driving all over North America... Members were puring into the NEW website and I had no idea how to activate them.

(WMMIA) Webmaster Missing In Action.

I'm moving along and wish Kyle & John all the best in their website adventure's.

Dan Davies

OK, so now that the database has been proven to be mine, as much as it is Dan's, let's take a look at the only statement that is really needed -- the Terms of Use every member agreed to when becoming a member (I know, I wrote the TOU!);

INTERNET-LOCKSMITH -- Terms Of Use

7. Submission of Content on this Web Site.
By providing any Content to our web site:
(a) you agree to grant to us a worldwide, royalty-free, perpetual, non-exclusive right and license (including any moral rights or other necessary rights) to use, display, reproduce, modify, adapt, publish, distribute, perform, promote, archive, translate, and to create derivative works and compilations, in whole or in part. Such license will apply with respect to any form, media, technology known or later developed;
(b) you warrant and represent that you have all legal, moral, and other rights that may be necessary to grant us with the license set forth in this Section 7;
(c) you acknowledge and agree that we shall have the right (but not obligation), in our sole discretion, to refuse to publish or to remove or block access to any Content you provide at any time and for any reason, with or without notice.

All of the information that I have posted here is available, publicly, on the internet -- and I've linked to everything above -- I've made no attempt to hide any of this information -- heck, I have it all posted on my own sites.

Have a nice day, Chiken Sh*t! ;)

Regards;
Kyle
